Protected Industrial Action (PIA)

IMPORTANT

Please be aware that with a successful "Yes" vote, all protected industrial action (PIA) must come to an end.

Protected industrial action (PIA) refers to lawful industrial action taken by employees and their union representatives during negotiations for a new Enterprise Agreement, or when disputes arise in the workplace. PIA can include strikes, stoppages of work, bans on performing certain tasks, and other actions aimed at putting pressure on employers to address employees’ concerns during bargaining.

PIA is conducted in accordance with the Fair Work Act 2009 (Cth) and must comply with specific requirements to be considered lawful. As the industrial action is protected, the employer cannot take adverse action against any employee for taking part in it.

The AFPA has taken all the necessary steps to prepare for taking PIA, but now we need you.

Below is the list of Protected Industrial Actions and the status of each action:

  • Green: Action is active in all locations and can be undertaken by any AFPA member.
  • Amber: Action is active in limited locations and can only be undertaken by members who are directly contacted by the AFPA.
  • Red: Action is not to be undertaken at this time.

Balloting for new PIA’s has closed on Tuesday, July 23, 2024, 96.78% of voted members have supported in favor of new PIA’s. It is important to note that new PIA’s (order No. 37 to 57) are still in RED and members would be informed once they are moved to Yellow or Green.
